TERMS OF PLATFORM USE

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE PLATFORM. These terms tell you the rules for using our website and services (the “Platform”). By using our Platform, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms, you must not use our Platform.

1. INFORMATION ABOUT US

The Platform is operated by Corelink Care (“we”, “us”, “our”). We are a company providing an introductory matching service between care seekers and care providers.

2. DEFINITIONS

  • Care Seeker: Any individual, family member, or representative looking to source care services.
  • Care Provider: Any professional, agency, or individual providing care services who registers on the Platform.
  • Employer: Any commercial entity or organisation offering Corelink Care as a benefit to its employees/staff.
  • Platform: The Corelink Care website, mobile applications, and matching technology.

3. SCOPE OF SERVICE

Corelink Care provides a digital venue for matching. We are NOT a care agency, a nursing agency, or an employer of Care Providers. We do not provide clinical advice or perform a regulated activity as defined by the Care Quality Commission (UK) or relevant State Health Departments (USA).

We do not employ Care Providers. Any contract for care services is strictly between the Care Seeker and the Care Provider.

4. CARE PROVIDER ACCOUNTS AND FEES

Care Providers must maintain an active, paid profile to receive leads and interact with Care Seekers.

4.1 NO REFUND POLICY: To the fullest extent permitted by law, all fees paid by Care Providers—including but not limited to profile subscription fees, lead generation fees, or listing fees—are NON-REFUNDABLE. No refunds or credits will be provided for partial months of service, or for any lead that does not result in a placement or contract.

4.2 NO GUARANTEE OF LEADS: We provide the technology to facilitate introductions but do not guarantee a minimum number of leads, the accuracy of lead data provided by third parties, or that any lead will result in an interview or employment. The service is provided ‘as is’.

5. EMPLOYER BENEFIT TERMS

Where an Employer chooses to add Corelink Care’s services for their workforce, this is provided as a free employer benefit for the individual employees (Care Seekers).

Employers are responsible for ensuring that their internal communication regarding this benefit is accurate. Corelink Care handles the matchmaking, but the Employer assumes no liability for the care outcomes of their individual employees.

6. USER CONDUCT AND PROHIBITED USES

You may use our Platform only for lawful purposes. You may not use our Platform:

  • In any way that breaches any applicable local, national or international law or regulation.
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising (spam).
  • To knowingly transmit any data, send or upload any material that contains viruses or any other harmful programs.
  • To attempt to solicit Care Providers or Seekers to move off-platform to avoid fees if applicable.

7. VETTING AND RESPONSIBILITY

Corelink Care may perform basic identity checks or surface-level verification. However, Corelink Care

DOES NOT:

  • Conduct comprehensive criminal background checks (DBS/FBI/State level) on every user.
  • Verify the clinical competency or medical qualifications of Care Providers.
  • Guarantee the safety or suitability of any Care Provider.

IT IS THE SOLE RESPONSIBILITY OF THE CARE SEEKER TO CONDUCT INTERVIEWS, CHECK REFERENCES, AND VERIFY QUALIFICATIONS PRIOR TO ENGAGING A CARE PROVIDER.

8. INTELLECTUAL PROPERTY

We are the owner or the licensee of all intellectual property rights in our Platform and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

9. LIMITATION OF LIABILITY

Nothing in these terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law or US Delaware law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Platform or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • Use of, or inability to use, our Platform.
  • Use of or reliance on any content displayed on our Platform.
  • Loss of profits, sales, business, or revenue.
  • Any interaction or incident occurring between a Care Seeker and a Care Provider.

10. GOVERNING LAW AND JURISDICTION

10.1 United Kingdom: If you are a consumer or a business in the UK, these terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. You and we both agree to the exclusive jurisdiction of the courts of England and Wales.

10.2 United States: If you are using the service in the USA, these terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Delaware.

11. TERMINATION

We may terminate your access to the Platform at any time, without notice, if we believe you have breached these terms or if your conduct is deemed harmful to the Corelink Care community.
